Our role in the proceedings

Have you received a summons bearing the name Van den Bosch | Advies & Incasso? If so, we are acting as authorised representative or legal adviser for the claimant — our client has instructed us to handle the case on their behalf. We are therefore not impartial: we act exclusively in the interests of our client.

This may concern a claim for an unpaid invoice, a contractual dispute, a tenancy matter or another civil claim. The summons sets out exactly why the proceedings have been commenced and what is being asked of you.

What does a summons mean?

A summons is an official document by which court proceedings are commenced against you. It is formally served by an enforcement officer. The summons states:

  • who the claimant is and who represents them;
  • what is being claimed from you (e.g. payment of an amount, including interest and costs);
  • which court will hear the case and on what date;
  • how you can respond and within what deadline.

Depending on the amount claimed, the case will be heard by the district court (claims up to €25,000) or the higher civil court (larger amounts). Further information about what a summons involves and how you can respond is available at rechtspraak.nl — Dagvaarding gekregen.

What can you do?

Always respond in time. If you do not appear at the hearing or fail to respond, the court may grant the claim without hearing your side of the matter (default judgment). You have the following options:

  • Acknowledge the claim and pay — in that case contact our office as soon as possible. We may be able to agree a payment arrangement and limit further costs.
  • File a defence — if you (partly) disagree with the claim, instruct a lawyer or authorised representative in good time. In district court proceedings a lawyer is not mandatory; in civil proceedings before the higher court one is required.
  • Reach a settlement — an amicable resolution remains possible even before the hearing. Please get in touch if you wish to discuss this.
