You have received a letter from us
No need to panic
Have you received a letter, email or demand notice from Van den Bosch | Advies & Incasso? This can feel unsettling, but there is almost always a solution to be found. We are acting on behalf of a client — for example a business or a landlord — who wishes to recover an outstanding amount from you. The sooner you get in touch, the more options are available.
The letter or email sets out exactly what is being asked of you and within what timeframe. Please read it carefully and do not hesitate to contact us if you have any questions.
What does the letter contain?
In addition to the outstanding amount (the principal sum), the letter may include further items. These are governed by law and typically look as follows:
- Principal sum — the original outstanding amount.
- Statutory interest — interest accruing on the amount from the invoice due date. The rate is set by law.
- Collection costs (extrajudicial) — a contribution towards the creditor's out-of-court costs. These too are capped by law.
- Court costs — these only arise if the matter is referred to court and you are found to be in the wrong; court fees and other costs would then be added.
The sooner you respond, the more limited the additional costs will remain. Do not wait too long.
What are your options?
- Pay — pay before the date stated in the letter. Not sure of the exact amount to transfer? Just contact us and we will provide you with the current total.
- Request a payment arrangement — unable to pay the full amount at once? Please get in touch as soon as possible. We will ask our client whether an arrangement is possible. The earlier you ask, the greater the chance of finding a suitable solution.
- Dispute the claim — do you (partly) disagree with the claim? Please let us know in writing, ideally with a brief explanation. We will pass your response on to our client and keep you informed of what happens next.
- Help with multiple debts — are you dealing with several creditors or financial difficulties that go beyond this single claim? Feel free to contact us — we are happy to think through a realistic approach with you. You can also turn to your municipality's debt counselling service, nibud.nl or the Juridisch Loket for free independent advice.
